Summary
Presentation given at an AIPPI meeting on 20 April 2018 on online platforms facing trade mark infringement. It examines when a hosting provider has knowledge of infringing offers, in the light of L’Oréal v eBay (C-324/09), the scope of injunctions that may be imposed on intermediaries, with Scarlet, Netlog, UPC Telekabel and McFadden, and keyword advertising since Google France. It ends with the negotiated approach of the memorandum of understanding signed on 4 May 2011 between right holders and platforms under the aegis of the European Commission.
