Summary
Case note on the first use of the procedure created by Articles XVII.34/1 et seq. of the Belgian Code of Economic Law, in force since 1 June 2024, against online infringement of copyright, related rights and database rights. It comments on the order of the President of the French-speaking Brussels Enterprise Court of 28 March 2025 and the decision of the new administrative Service of 1 April 2025, obtained by The 12th Player and DAZN to block illegal streaming of Belgian Pro League football at the level of Belgian internet access providers and alternative DNS resolvers. The note analyses the ex parte procedure, the requirement of a manifest and considerable infringement, the balance of interests and the dynamic updating of the measures by the Service. It criticises the uncapped penalty payments of EUR 100,000 per day imposed on the alternative DNS resolvers.
