Presentation given on 2 October 2018 on how to handle a descriptive seizure. It explains the purpose of measures to preserve evidence under Article 7 of Enforcement Directive 2004/48 and typical situations, such as counterfeits distributed by an obscure company or a competitor suspected of using a patented process. It then presents the Belgian procedure of Articles 1369bis/1 et seq. of the Judicial Code: available for all intellectual property rights, with a low threshold, ex parte by nature and powerful in practice.
