The media storm

Summary

Belgian contribution to the Media Law International guide on recent developments in the Belgian media landscape. It discusses the two decisions against Bhaalu, a service that recorded television programmes in the cloud: the Commercial Court of Antwerp held that the user makes the copy but refused the private copying exception because the source was unlawful, and found an unauthorised communication to the public; the Flemish media regulator then issued a warning. It covers the judgment of the Brussels Court of Appeal of 12 November 2014 requiring Telenet to open its cable network to alternative operators, and the acquisition by Telenet and Liberty Global of 50 per cent of De Vijver Media, cleared by the European Commission subject to commitments.
