Summary
Presentation given at the FEB on 2 June 2015 on the abuse of intellectual property rights. It discusses abuse of a dominant position, with the Huawei v ZTE case on standard-essential patents and the opinion of Advocate General Wathelet, the dispute between SABAM and Tomorrowland, and United Video Properties (Rovi) v Telenet. It concludes that abuse is easier to establish when the right holder is dominant, and contrasts the Belgian approach to injunctions with the US eBay v MercExchange test.
