Copyright protection of computer software, and liability of internet intermediaries

Summary

Presentation given at an IP seminar on 28 March 2011 in two parts. The first reviews recent case law on copyright protection of computer software: the CJEU’s BSA judgment (C-393/09) on graphical user interfaces, ownership of rights in software before the Belgian Court of Cassation, a judgment of the EU General Court of 16 December 2010 and the reference in SAS Institute (C-406/10). The second deals with the liability of internet intermediaries and the questions then pending before the Court of Justice.
