Intellectual property rights on databases

Summary

Presentation of 10 June 2008 on the protection of databases under Directive 96/9/EC. It distinguishes copyright, which protects the original selection or arrangement of the contents, from the sui generis right, which protects a substantial investment in obtaining, verifying or presenting them, and sets out for each the exclusive rights, the exceptions for teaching and scientific research, and the duration. The last part applies these rules to research consortia: who owns the rights, access rights to pre-existing knowledge, and how publication and commercialisation are dealt with in the consortium agreement.
