La protection de la confidentialité des communications des mandataires en brevet

Summary

Presentation given at an AIPPI meeting on 23 November 2017 on the confidentiality of communications with patent attorneys. It reviews Belgian law, which recognises no privilege for these communications, comparative law and the BMS v RPR case, the rules of the European Patent Convention and of the Agreement on a Unified Patent Court, and international law. It ends with the proposal made in June 2013 by AIPPI, AIPLA and FICPI to protect such communications from disclosure.
